Fort Myers woman wins $1 million in DUI court case
A Collier County jury awarded the victim of a drunk driving accident a little over $1 million Friday.
Kimberly Carpenter, 37, of Fort Myers won the $1,050,979 verdict against Donald Clawson of Naples, after a four-day trial.
Carpenter received a neck injury when Clawson struck Carpenter’s SUV and two other vehicles while going through the intersection at David Boulevard and Airport Pulling Road in Naples.
Clawson already had three DUI convictions. He testified he had only one beer that morning and passing out from a coughing attack is what caused the crash.
The jury gave Carpenter $25,979.15 for past medical bills, $250,000 for future medical bills, $200,000 for past pain and suffering, $300,000 for future pain and suffering and $275,000 for punitive damages to punish Clawson for his conduct and deter others from driving drunk, said Randall L. Spivey, Carpenter’s attorney.
