The Judicial Panel on MultiDistrict Litigation has granted the motion to centralize peanut butter cases and has selected the Northern District of Georgia as the transferee court. The Judicial Panel granted the motion to centralize the cases and selected the Northern District of Georgia because three class actions (and two tag-along actions) are pending there, because common defendant ConAgra supported transfer there if the case was not sent to Missouri, and because the manufacturing plant where the contamination occurred and the governmental agency that investigated the contamination are located there. According to the ruling, the cases will be heard in the Northern District of Georgia because they share common questions of fact, all plaintiffs allege harm from consuming and/or purchasing contaminated peanut butter that was manufactured and packaged at ConAgra’s Sylvester, Georgia plant, and centralization will avoid duplication of discovery as well as prevent inconsistent pre-trial rulings.
