The DePuy ASR metal on metal hip implant settlement of over seven thousand lawsuits has been extended to cover hundreds or thousands of new ASR hip implant patients. The original billion dollar settlement of the product liability lawsuits in 2013 covered those hip implant patients who had to have a DePuy ASR hip implant surgically replaced before August 31, 2013. The enlargement of the settlement program announced today extends the date of eligible hip revision surgeries through January 31, 2015.

The ASR hip was recalled in 2010 as a result of high failure rates due to metal leaching from the implants causing damage to the hip tissues called metallosis.

The settlement provides a base payment of $250,000 for each failed hip with reductions or enhancements based upon a number of difference criteria set forth in the settlement. Most of those in the initial settlement group have received their base payment. Additional payments for complications or extraordinary injuries for the initial settlement group have no yet been paid but those payments are expected to begin in March 2015.

No timetables or enrollment dates for those in the new enlarged settlement group have been announced.
